شهادات ضرورية
- أ – شهادة الملكية هي شهادة تثبت الوضعية القانونية والمادية للعقار وقت تقديم الطلب
- ب – الشهادة الخاصة بتقييد الرهن هي شهادة تثبت تقييد الرهن بالرسم العقاري طبقا لمقتضيات الفصل 58 من الظهير في 09 رمضان 1331(12 أغسطس1913) المتعلق بالتحفيظ العقاري كما تم تغييره وتتميمهو تكون لهذه الشهادة الخاصة قوة سند قابل للتنفيذ (أنظر الفصل 214 من الظهير الشريف الصادر في 22 نونبر 2011، بتنفيذ القانون رقم 39.08 المتعلق بمدونة الحقوق العينية كما وقع تتميمه).
- ج – شهادات أخرى هي شهادة تثبت الوضعية القانونية والمادية للعقار وقت تقديم الطلب
- شهادة خاصة بالتقييد؛
- شهادة تتعلق بتقييد أو تقييدات معينة؛
- شهادة عدم التقييد بالسجل العقاري؛
- شهادة تثبت المطابقة بين الرسم العقاري ونظيره .
