التفويت الكلي
يعد التفويت الكلي أو الجزئي لملك عقاري كقطعة أرضية مثلا إجراء قانونيا يسمح باستخراج أحد الأصول من ملكية صاحبها. يسمى المالك بالمفوت أما المستفيد من التفويت فيسمى المفوت له.
و من الإلزامي بالنسبة للأشخاص الراغبين في تفويت قطعة أرضية بغية إخراجها من الملك الأصلي إتباع المسطرة المبينة أدناه
الوثائق المطلوبة للتفويت الكلي
- عقد التفويت محرر طبقا للقانون الجاري به العمل مسجل ومتضمن لبيانات مطابقة لما هو منصوص عليه بالرسم العقاري أو بمطلب التحفيظ.
- نظير الرسم العقاري إذا تعلق الأمر بعقار محفظ، وكان الحق موضوع التفويت متوقفا بالضرورة على موافقة المالك المقيد الحائز للنظير.
- رخصة الشراء على الشياع، عند الاقتضاء، تسلم من طرف الجماعة المحلية المعنية طلب التقييد عند الاقتضاء.
