شروط عقد الرهن العقاري
الرهن العقاري هو اتفاق قانوني ينقل الحق في ملكية أحد الأصول أو الممتلكات العقارية من مالكها إلى المقترض كضمان مقابل الحصول على القرض، وبعد ذلك يتم تسجيل الفائدة للمالك الأصلي في سجل مستندات الملكية ويتم إلغاؤها عند سداد القرض بالكامل ولا يجوز للمشتري بيع العقار إلا بعد تسديد الرهن، ومن المعروف أيضا أن أي ممتلكات يمكن رهنها كما يمكن الحصول على أمر حجز من المحكمة لبيعه إذا ما تخلّف المقترض عن السداد، ويجب أن يكون الرهن العقاري محدد الفترة الزمنية و للمرتهن حق الاسترداد عند سداد مبلغ القرض.
شروط عقد الرهن
و يجب لصحة عقد الرهن الرسمي أن يتضمن مايلي:
- هوية أطراف العقد؛
- تعيين الملك المرهون ببيان إسمه وموقعه ومساحته ومشتملاته ورقم رسمه العقاري أو مطلب تحفيظه؛
- بيان مبلغ الدين المضمون بالرهن والمدة المحددة لأدائه
